GIFT CARD TERMS AND CONDITIONS

1. GIFT CARD USER AGREEMENT

This agreement (the “agreement”) is entered into between Hal Smith Restaurants (the “gift card issuer”) and you. It describes the terms and conditions governing the use of Hal Smith Restaurants gift card (the “gift card”). By purchasing and using the gift card, you agree to accept the terms and conditions of this agreement, which are subject to change at time without notice.

2. GIFT CARDS

Hal Smith Restaurants Gift Cards are redeemable at any Hal Smith Restaurant location.
Hal Smith Restaurants Gift Cards are available for purchase at https://halsmith.com/.  
No fees of any kind will be imposed on purchasers or recipients of Gift Cards.

3. REDEMPTION

When the gift card is purchased, the available balance will be the activated value. The initial available balance will be reduced each time the gift card is used, and the residual value will appear on your receipt. The balance is neither refundable nor redeemable for cash or credit.

4. VIEW YOUR BALANCE

To view your Gift Card balance, go to https://halsmith.checkyourcardbalance.com

5. RETURNS

You may not return or cancel your Hal Smith Restaurants Gift Card after it is received. Purchasers who wish to cancel a Gift Card purchase order prior to its delivery to a recipient should contact Customer Support.  https://halsmith.com/contact-us/

6. LOST OR STOLEN GIFT CARDS

If you suspect that someone has copied or stolen your Gift Card, contact Customer Support immediately. Gift Cards will not be replaced if lost or stolen without proof of purchase. Gift Cards have cash value and should be safeguarded accordingly.

7. LIMITATIONS

You may not use a Gift Card to purchase other Gift Cards.

8. RISK OF LOSS

Ownership and risk of loss of Gift Cards passes to the purchaser as soon as we send our confirmation to the recipient. We are not responsible for lost or stolen Gift Cards.

9. HAL SMITH RESTAURANTS GIFT CARD CUSTOMER SERVICE

If you need assistance with any aspect of your purchase, ownership, or use of your Gift Card, please contact Customer Support.  Please refer to your order number, or be ready to supply your email address.

10. PAYMENT METHODS

Hal Smith Restaurants Gift Cards may be paid for with a valid VISA, MasterCard, or American Express.

11. DELIVERY INFORMATION AND REQUIREMENTS FOR GIFT CARD PURCHASERS

All orders of Gift Cards are subject to a process that compares purchaser information provided on the web site with information about the purchaser provided by the purchaser’s financial institution. If there is a discrepancy, your Gift Card order may be delayed until it can be corrected. 
If you have concerns about your order, please contact Customer Support.  Please refer to your order number, or be ready to supply your email address. 
We are not responsible for Gift Cards that are undeliverable or not received due to your failure to enter an accurate physical address or email address for the recipient. Please check to make sure the address of the recipient is correct and contact Customer Support if you suspect the recipient did not receive his/her Gift Card.

12. REASONS FOR FAILED DELIVERY OF EGIFT CARDS

eGift Cards are delivered via email. If you have confirmed the recipient’s email address but the eGift Card has not been viewed within a reasonable period after the requested delivery date, following is a list of the most common reasons why delivery may have failed:

1. Spam filter blocked email or routed it to a bulk/spam folder

2. Recipient’s firewall blocked the email

3. Email inbox is over size limit

4. Invalid email address

If a spam filter is blocking Hal Smith Restaurants Gift Cards emails from getting to an inbox, the email options will need to be modified so that Hal Smith Restaurants Gift Cards emails are not considered spam.

13. PERSONALIZED MESSAGING

If you wish to add a personal message to a Gift Card, simply type your message in the Message field during the purchase process. 
Personal messages are limited in length to the space provided on the eGift Card, or to the space provided on the presentation carrier of a physical Gift Card. 
There is no additional charge to include a personalized message. 
We don’t read every gift message, but if we do find inappropriate, offensive or otherwise objectionable messages, we reserve the right to cancel them. Thanks for your cooperation.

14. TERMINATION OF THE PROGRAM

Hal Smith Restaurants reserve the right to terminate the Hal Smith Restaurants gift card program at any time, in which case, it will notify the cardholders through its website of the program’s termination and the terms respecting the use and refund of any available balances on the gift cards.
